Moscow City Court rejected an appeal to release Russain opposition figure Alexei Navalny in connection with the 'Yves Rocher' case in Moscow on Saturday.

"[Court decided] to change the decision of the Simonovsky District Court of Moscow of February 2, 2021, concerning convict Alexei Anatolyevich Navalny. [Court decided] to set off the term of serving the sentence - the time when Alexey Anatolyevich Navalny was under house arrest in the period from December 30, 2014, to February 18, 2015. The rest of the decision to leave unchanged, appeals were dismissed. The appeal decision may be appealed constitutionally," said the judge.

According to Navalny’s lawyer Vadim Kobzev, he will spend two years, 6 months and two weeks in the penal colonies.

Prosecutor Ekaterina Frolova highlighted that the penal correction inspection was inactive during Navalny's hospitalisation in Berlin.

"However before 20th of August 2020, Alexei Anatolyevich had broken the terms of the probation which were established by Moscow’s Zamoskvoretsky Court and Moscow’s Lyublinskiy Court as I said before. Also after being discharged from Charite hospital on 23th of September 2020 Alexei Anatolyevich didn’t inform the penal correction inspection about his location and didn’t come for registration for two months, till November 2020," Frolova said.

Navalny was sentenced on February 2 to two years and eight months in a penal colony for violating parole conditions imposed in 2014 for embezzlement charges.

He is also accused of defaming a World War II veteran who spoke in favour of Russia’s constitutional amendments last year. The prosecutor has asked the court to fine the Kremlin critic 950,000 roubles (€10,600, $12,850).
